Did you know that as a part year worker, i.e. someone who works irregular hours, the law is very particular about how your pay should be calculated? In 2022 the Supreme Court ruled in favour of a school teacher who only worked certain times of the year but claimed she had not been paid her holiday pay correctly. The school had calculated Mrs Brazel's pay as the statutory 5.6 weeks x an average of what she had worked in the reference period. The reference period was the term. The Supreme Court ruled this was not in compliance with the law. What the school should have done, is defined the reference period as the last 12 PAID weeks, rather than the last 12 weeks in general. There were some weeks Mrs Brazen did not work as she was a musical instrument teacher. (Please note. The 12 week period was amended in 2020 to 52 weeks. But at the time in question, it was 12 weeks.) So what does this mean for you? Make sure your holiday pay entitlement is calculated using the correct information. Your average weekly pay should be an average of the last 52 *paid* weeks. This may mean your employer needs to go back by more than a year if you do not work every week. Any weeks you did not work should be ignored and not used in the calculation.
