Can I get divorced in Scotland if I do not know where my spouse is?
Yes. Serving of the divorce application can take place in many ways such as walls of court or by placing a notice in a newspaper. We will provide you with guidance on what to do in this situation.
Do I need to go to court?
No, not if the divorce goes unopposed. If your spouse does oppose it, then you may need to attend court to explain matters to the Sheriff. If this does happen, you should consider instructing a local Divorce Solicitor in your area of Scotland.
If I had the affair, can I apply for divorce?
You cannot use your affair as the ground for divorce, as this is only open to your spouse. You would need to use another ground, such as 2 years' separation. Our questionnaire on the home page will tell you what option to use.
If we have not agreed to how all assets are split, can I still use Online Divorce Scotland?
This depends whether it is capable of being agreed. If you are able to discuss this, we would recommend going for a settlement agreement first. Once you have this, then you can proceed with a divorce using our service.
If my spouse opposes divorce after papers have been served, what do I do?
In the first instance, contact us and we will talk you through this. We will most likely put you in touch with a local solicitor who can represent you in court.
